14. Dispute Resolution — Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

You and Wave Goods agree that any dispute, claim, or controversy arising out of or relating to these Terms or the purchase of any product — except for matters that may be taken to small claims court — shall be resolved by binding arbitration, rather than in court.

• The arbitration will be conducted by a recognized arbitration provider (such as the American Arbitration Association) under its applicable consumer rules, in Howard County, Maryland or another mutually agreed location, or via remote/online proceedings where available.
• The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver. You and Wave Goods agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class proceeding.

30-Day Opt-Out. You may opt out of this arbitration agreement by sending written notice to info@waveassetmanagement.com within 30 days of your first purchase or acceptance of these Terms. If you opt out, neither you nor we will be bound by the arbitration and class-waiver provisions.

This section does not prevent either party from seeking injunctive or equitable relief for intellectual property infringement in court.

15. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict-of-law principles. Subject to the arbitration provision above, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Howard County, Maryland.
